THE CYBER RESILIENCE ACT DECODED: LEGAL AND STRATEGIC IMPLICATIONS FOR INDUSTRY

COURSE OBJECTIVES
The Cyber Resilience Act (CRA) is a new European regulation on cybersecurity requirements. It is important for in-house counsel to know because it provides solutions to the significant increase in cyber-attacks and strengthens cybersecurity obligations for most companies. This training helps companies determine whether they are subject to the CRA and, if so, to identify the main obligations. It will provide information to identify to whom the CRA applies and to which products, the classification of actors and the main related obligations. For this purpose, we will go through the timeline of entry into force of the CRA, its material and territorial scope, the sanctions for breach of the CRA’s provisions, the classification of products with digital elements and the obligations of the stakeholders. The training will also provide an opportunity to discuss with the participants the uncertainties to date of the CRA and the difficulties in interpreting some of its provisions.

PROGRAM CONTENT
     •   Determine whether your company’s products or software fall under the CRA’s scope and exclusions
    •    Understand the CRA’s material and territorial application, including its relationship to NIS2 and sectoral legislation
    •    Identify your role under the CRA (manufacturer, importer, distributor) and the corresponding obligations
    •    Navigate lifecycle obligations: cybersecurity requirements from planning and design to maintenance and post-market support
    •    Learn about CE marking for products with digital elements and how it ties into CRA compliance
    •    Examine third-party conformity assessment requirements for critical products
    •    Understand the new compliance timeline: what is expected before and after December 2027
    •    Discuss penalties for non-compliance and how to mitigate risk
    •    Explore interpretive grey areas and pending guidance from the CRA Expert Group

CERTIFICATION
ECLA will issue a certificate to each participant at the end of the course indicating the exact hours of training.
